WAIVER OF LIABILITY AND ASSUMPTION OF RISK - PLEASE READ CAREFULLY
I understand that my participation in the Madison, AL Witches Ride (the “Activity”) scheduled for October 18, 2026 on property owned by the City of Madison and Madison City Schools, does not establish any liability on the part of the City or the Schools for any potential injuries and/or other injuries I may suffer on said recreational property. I agree that I am participating in this Activity by my own free choice and will act in a responsible manner. I will follow applicable rules and regulations pertaining to the Activity. In consideration of being allowed to participate in the Activity, I hereby agree to assume the risks of property damage, injury, illness, or death in any way associated with my participation in the Activity. I recognize that the program requires physical exertion that may be strenuous at times and may cause physical injury and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the above-mentioned program. I represent and warrant that I have no medical condition that would prevent my participation in the program. I agree to assume full responsibility for any risks, injuries, or damage, known or unknown which I might incur as a result of participating in the program. Such injuries may include, but are not limited to: heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness, including death. I agree to release, defend, indemnify, and hold harmless the City, its officials, employees, representatives, volunteers, and agents for any and all rights and claims for damages, including attorney fees, I now, or may hereafter have, whether known or unknown, in law or in equity, and arising from or in any way connected with my participation in the Activity. I agree that the terms stated herein shall also serve as a waiver of liability and assumption of risk for my heirs, estate, executor, administrator, assignees, and for all members of my family.
I acknowledge that I have carefully read this waiver of liability and assumption of risk and fully understand that I am waiving any right that I may now or hereafter have to bring a legal action to assert any claim against the City of Madison, Madison City Schools, Event Coordinators or Partners, in connection with my participation in the Activity.
A parent or guardian signature is required if the participant is under 19 years of age. By signing this waiver of liability and assumption of risk on behalf of a minor, the undersigned parent or guardian is agreeing to be bound by the above conditions on behalf of him or herself and on behalf of the participant.
OFFICIAL EVENT REGULATIONS
This is a charity event benefiting Madison Arts Alliance. Madison Visionary Partners (MVP) is a community nonprofit in Madison, Alabama. We are working to provide the people that live and work in Madison a place to make their donation dollars and volunteer hours go towards making a difference specifically to our Madison City community.
I understand that the Madison, AL Witches Ride (the “Activity”) is an athletic event that should only be engaged in by persons who are physically fit and in good health, as determined by a physician. I also understand that my participation entails some risks, including but not limited to injury or death, caused by my actions as well as the acts or omissions of fellow participants.
I acknowledge the entry fee of $50 is non-refundable; I understand this is a donation to Madison Arts Alliance.
I attest and verify that I will participate in this Event as an entrant, that I am 19 years of age or older, or am a parent signing the waiver for a witch 13-18 years old, am physically fit for this Activity, and accept all risks associated with my participation. Further, I hereby grant full permission to the Madison, AL Witches Ride and the organizers to use without compensation any photographs, videotapes, motion pictures, or any other recordings or other records of this Event containing my image for any purpose whatsoever.
BY ENTERING THIS RIDE YOU AGREE TO THE FOLLOWING CONDITIONS:
Be Respectful: Only “family-friendly” costumes will be permissible to participate in the event. Any costume or decorations considered unsuitable or too scary for children will be asked to change or leave. No political signage is permitted.
Be Responsible: Safety is imperative to the success of the event. Please no alcohol before or during the event.
If needed, please stop to help distressed witches, let’s ensure everyone makes it safely to our destination.
Make sure your costumes and decorations are suitable for walking.
Please remain in single file order when stopped to wave at the children and other spectators. You must remain between the designated markers.
Flying Monkeys will be present to help organize, enforce rules and answer questions. DO NOT QUARREL WITH THE MONKEYS.
